SALTASH, CORNWALL, UK, June 3, 2009 --/WORLD-WIRE/-- Following the accusations made by Mr Harris and PowerMaster this statement is issued to countermand the claims made and to set out the facts of the matter. The lawsuit filed in the Adams County District Court of Colorado, USA, has not been acknowledged or defended by either GAR-tech or Mr Reffell upon the advice received by them from solicitors acting in the UK. All accusations made in the lawsuit or denied and indeed, within the possession of the company and Mr Reffell there exist a large number of documents in support thereof. In particular Mr Reffell has correspondence granting a “Sole Agency Agreement” for the European Union, and whilst this agreement was in force there is proof that Mr Reffell assisted in the sale of a unit to several prospective buyers. Mr Harris was present at the time of demonstrations of the equipment with Mr Reffell. The Vertical Gyroscopic Mill was patented in 1952, 1960, 1964, 1975, and 1976 by Mr A L Burkett. All these patents have long since expired. In 1979 a full working VGM was installed in the USA and a descriptive video publically released. Gar-Tech’s team of researchers and engineers have worked from these expired patents to develop an entirely new model including many exciting new features and ideas to design a new machine that has no connection to that sold by PowerMaster, and which is currently undergoing patent and copyright proceedings in the UK. Machines sold and delivered by PowerMaster failed to meet expectations from the customers and also and perhaps more importantly failed to reach standards for safety and certifications including CE, BSS,HASOP, Health and Safety (SOMSR Part III , Schedules 2 & 3 & PUWER 98 refer). We have in our possession a report from Lloyds condemning the design of the PowerMaster under EU Health & Safety Regulations. In addition to the above we have received a number of other independent complaints relating to the PowerMaster, these are consistent with those experienced by buyers of machines between 2002 and 2008, consequently upon which the Lloyds report was commissioned and following which we were engaged to rebuild that machine to comply with the relevant standards and to achieve a working usable safe unit. Those other complaints also include the failure by the manufacturers to provide CE certification, and indeed demands for additional payment for the supply thereof. The certificate that was supplied by PowerMaster was ultimately found to be a forgery. Gar-tech and Derek Reffell wish to jointly announce that any attempts to suggest that the machine being manufactured by this company in any way represents designs of, or technology owned by PowerMaster are untrue. The machine now being produced is a new design using only the technology designed in the now expired patents of A L Burkett. Reluctantly, if Mr Harris and PowerMaster continue then if necessary action will be bought in the UK courts against those parties for Libel and Defamation.
