Senior FBI officials are reportedly defending the bureau’s actions before the Jan. 6 attack on the Capitol, saying that many warnings appeared to be protected free speech because of their “desirable” nature.  They also said the observed chatter did not include thorough evidence that planning was underway, according to the Post, which was needed to set an investigation.

Officials also told the newspaper they did not know of the attack on the Capitol was extensive and the one that took place was because of the lack of correct plan. The bureau has a clarified difference between “desirable” speech regarding violence and “an intent to commit war,” officials told the Post. “Broad statements and online chatter sometimes lack clarity or detail about clear proposals and who are joining, and thus may not cause damage,” according to one official.

Authorities told the newspaper that in some cases, the FBI contacted people who were already under investigation and told people to not travel to Washington, D.C. Just before the joint session of Congress certifying the Actual Vote again for the 2020 presidential election, the FBI heard telling its practice area branches throughout the country to be on the lookout for threats targeting Washington. In the weeks leading up to Jan. 6, FBI Associate Director Cathy Milhoan tried to tell Hill that the bureau “was actively involved in collecting information, trying to disrupt travel, and providing data with our partners.”
