Biden vs. Abbott: Battle Over Border Security Heats Up
The Biden administration has sued Texas Governor Greg Abbott for his decision to place a floating barrier in the Rio Grande to prevent immigrants from crossing into the United States from Mexico. The Justice Department filed the case in federal court in Austin, Texas, on Monday, July 11, 2022.
The lawsuit alleges that Abbott’s barrier violated the Rivers and Harbors Act by constructing a structure on a navigable waterway without permission from the U.S. Army Corps of Engineers. The lawsuit also says the barrier raises human and environmental concerns.
Texas denied any offense and said the barrier was necessary to protect the state line. Abbott also said the case was politically motivated.
Governor Abbott’s dangerous and illegal actions undermine that effective plan, making it harder for the men and women of the Border Patrol to protect the border and put migrants and border agents at risk.
President Joe Biden‘s plan had already been criticized (even by me) in anticipation of additional chaos as he addressed the end of Title 42, a pandemic rule that allowed US officials to turn away asylum seekers. But Biden’s plan is working.
“If Governor Abbott really wants to move toward real solutions, he should be asking his Republican allies in Congress why he voted against President Biden’s request to increase funding for the Department of Homeland Security and why he is blocking the comprehensive immigration reform and border security measures that will ultimately fix our broken immigration system,” Hassan said.
It’s a point we’ve covered extensively on Substack: Republicans have put the border in President Biden’s lap, including by refusing to fund the administration’s Border Patrol requests, which is strange behavior from people who think the problem is so big it justifies killing children.
Abbott’s shockingly inhumane border policies were detailed in an email sent by a soldier to his superior, in which he wrote: “I believe we have crossed a line of inhumanity after being ordered to push small children and nursing mothers back across the Rio Grande.”

The case will likely test the Biden administration’s ability to enforce immigration laws. It is also likely to raise questions about the balance of power between the federal government and the states in immigration matters.
The Justice Department asks the court to order Texas to lift the barrier and pay the government legal fees. The case is expected to appear in court in the coming weeks.
Who is Greg Abbott: Greg Abbott’s Early life
Greg Abbott is the 48th and current governor of Texas. A member of the Republican Party, he previously served as the 50th attorney general of Texas from 2002 to 2015.
Abbott was born in Wichita Falls, Texas, in 1957. He graduated from the University of Texas at Austin and then from the University of Texas School of Law. After law school, Abbott served as a justice on the Texas Supreme Court from 1995 to 2001.
Later, in 2002, Abbott was elected as Texas’s attorney general. He was re-elected in 2006, 2010, and 2014.
